Nature of request
Wise complains that he holds an acre of land in Biskovey by knight service from the prince for a certain quit rent, but Bodrugan pretends a title to the same acre and surmises that it should be held from him by knight service, and at midsummer last past distrained Wise in a certain sum, for which if it were suffered, should be to the lord's disinheritance, and they menace his servants who dare not occupy the same. Wise requests that Bodrugan be called to answer the premises and to set such directions as shall be thought right.1)
Nature of endorsement
Philip Wise against Bodrugan.2) As to anything comprised in this bill, Bodrugan answers that it is not certain or sufficient in the law to put him to answer, but it is a matter determinable at common law wherefore he requests a respite to answer to the residue comprised in this bill, how be it that he says that John Wise, father of the petitioner was seised of a messuage and an acre of land Cornish with the appurtenances in Biskovey in his demesne as of fee etc., and so seised, held the same of Bodrugan as of his manor of Tregrehan by fealty and rent to be paid at the feast of Michaelmas annually, and suit to his court of the manor every three weeks, of which service Bodrugan was seised, and afterwards John Wise died seised, and Bodrugan distrained for the relief.
