Folio 202. Draft letter from the Poor Law Commission to Thomas Dryden, [Auditor, Truro Poor Law Union], Truro, acknowledging his letter of 20 September 1841, concerning the debt of Tregony parish to Mr Ball [Nicholas Ball]. They approve generally of his procedures in relation to individuals claiming a debt against parishes, which arose before the passing of the Poor Law Act. He is right to ask for evidence of compliance with 59 Geo III c 12, before allowing payments of principal or interest. They explain the differences between the cases of Kea and Tregony. There is a doubt in the Tregony case, as the statute has expired, but the Commissioners quote the legal precedent of K V Carpenter 6 A and G 794, which they think could be used to enforce repayment of the debt. The Commission do not think repayment is illegal and advise the parish officers to do this out of the rates or from the proceeds of the sale of their workhouse.
