John Harecourt states that he has long been in peaceful possession of the lands of Smallbrook and Morton on the Isle of Wight, and that he purchased a writ under the Statute of Northampton that no-one was to remove him from his free tenement without due process, but that in June in the King's second year, Thomas Russell, William Dale and Husson, servant of Thomas Russell, with others, expelled him forcibly from his lands and tenements, and have threatened him with loss of life and limb, so that he has not dared to return to his lands. He asks the King to grant a writ for them to come before him on a certain day to answer on the matter, and to give him a due remedy.
Nature of endorsement
[On face] The King wills, by the advice of his council, that, if it seems to them that the petitioner is not of sufficient power to sue at common law against his adversaries named in this bill, and if the claim he makes against them is true, the Chancellor is to issue writs to have the said trespassers appear before the council to answer on the trespasses committed by them against the petitioner; and on the advice and at the discretion of the council and the justices he is to have a remedy for the aforesaid trespasses.T. Erpyngham.[On dorse] On 23 June in the fourth year etc., it was agreed that if the petitioner will find sufficient security in Chancery to pursue his intention on the claim contained in the petition, and to give satisfaction for the costs of the people against whom he complains if he cannot prove his intention, according to the form of the statute provided for such a case, then writs are to be addressed to the said people to be before the council on a certain day to be specified by the Chancellor, to answer on the matter contained in the petition.By the council, in the presence of the Chancellor, the Keeper of the Privy Seal, T. Erpyngham, H. Waterton, and J. Cheyne.
