Report of Beaumont Hotham on 1 individual petition (Mary Smith, prisoner's mother) on behalf of William Smith, convicted (with John Hall) at the Kent Assizes at Maidstone, for waylaying a wagon, coming out of Tunbridge. The judge explains that he may have confused the case of William Smith with a John Smith (convicted at the same assizes) and giving his apologies. Grounds for clemency: previous good character and for the sake of his widowed 'Poor Old Mother's Distracted Mind'. Initial sentence: transportation. Recommendation: both Smith and Hall should receive the same; to go abroad in the service of the East India Company. Folios 185-188. See also HO 47/14/33, folios 177-180.
