Touching a grant made by the plaintiff John Curson and one Humfry Yeo of the herbage and land inclosed of said castle to the plaintiffs and to Sir Coplestone Bampfield, bart (since deceased). Was the estate and term in said grant purchased with part of the public money or stock belonging to Devon, and the said grant made to said persons (being then deputy "live-tenants of said county), in trust for the public use? Whether defendants took a lease of the herbage and lands inclosed, to com'ence after plaintiff's said term, without their consent or knowledge, and whether the lease to defendants is granted in trust for the only use and behoof of plaintiff Curson, obtained without his knowledge, and not made over to him? etc. Repairs of castle. Value of herbage.
