Description

Short title: Boteler v Marquis of Worcester.

Plaintiff(s): Edward Boteler.

Defendant(s): The Rt Hon Henry Marquesse of Worcester.

Subject of depositions: Manors of Great Badmonton, Little Badmonton, Allens Grove and Shrubs, lying in the parishes of Great Badmonton, Little Badmonton, and Hawkesbury (Gloucestershire). Mortgage of the manors by Nicholas Boteler (plaintiff's grandfather) to Arthur Crew, of Hilsely (Gloucestershire), and a grant of the premises by Nicholas (about 10 James I) to Edward Earl of Worcester (defendant's great grandfather). Was such grant "an absolute indefeasible estate or a mortgage, or defeasible upon payment of any money" etc. [The names of Sir Thomas Somerset, afterwards Visct. Somerset (son of Earl Edward), the Hon Mrs Elizabeth Somerset (daughter of Sir Thomas), "Nicholas Boteler, the plaintiff's grandfather, and Sir "Allen Boteler, his father" Sir Robert Poyntz, and the sequestration of the premises, are mentioned].
