Description

Short title: Lumbard v Attorney General.

Plaintiff(s): Thomas Lumbard, Thomas Townsend, Matthew Whaites, Thomas Penny, Thomas Harris, the son of George Harris, Mary Troute, the relict of George Troute, George Betty, the son of Roger Betty, Joyce Kyte, widow, the relict of George Kyte, deceased, Mary Pike, widow, the relict of William Pike, of the parish of Combe St Nicholas (Somerset), Robert Chutt and John Meacham, churchwardens of said parish, and Roger Matthewes and John Willey overseers for the poor of said parish.

Defendant(s): Sir Jeffrey Palmer, kt and bart (Attorney General), Henry Bonner, the elder, Henry Bonner, the younger, John Broom.

Subject of depositions: Forest of Roche alias Neroch, within the said parish of Combe St Nicholas. Touching 162 acres set out to His late Majesty Charles I for his third part of the lands parcel of such forest Sale of said 162 to the neighbours adjacent. Value of purchase. Relinquishment of purchase to Henry Bonner, the elder, the vicar of Combe, and others, on the understanding that they would purchase same to the continual use and to the relief of the poor, and sold by Henry Bonner and others aforesaid to plaintiffs "for the raysing of moneys for the discharge of the fyne of six hundred pounds." Alleged damage sustained by plaintiffs "for want of their leases" and they complain of defendants' delay in acting up to their agreement.

Date of commission: 28 November 1667.
