No 38.

Captured ship: Industry of London, otherwise Industria (master Nathaniel Grantham).

History: an English merchant ship (250 tons, 18 guns, 30 men, 5 men left aboard when seized, built at Ipswich in 1667), bound from Venice via Cesenatico (near Ravenna), Bari, Messina and Livorno (Leghorn) to the Downs, London, and Hamburg (Amsterdam cancelled), laden with silks, glassware, brimstone, aniseed, cumin, almonds, soap, drugs, and other goods; arrived at Portsmouth on 13/23 May 1672 and seized there about 15/25 May 1672 as droits to the Lord Admiral's use. At Venice, Amsterdam was originally an optional destination for some of the lading, at the master's discretion, but this option was cancelled by instructions he received at Livorno. The ship is said to have received news of the outbreak of war whilst off Portugal.

Allegation and claim (no date, 6 pages) of John Christopher Pomer, Paul Jennish (otherwise Jenins) and Arnold Fulgrave, for the ship Industry and cargo seized at Portsmouth.

Saltpetre laden at Leghorn (Livorno) for Venice was on the account of Fredericke Rishell (otherwise Rishells) of Amsterdam. A good part of the lading now claimed was from the proceeds of this saltpetre. Harmans, Lunenchusen and Capellen mentioned in the proceedings were all born in the Dutch Republic and are subjects of the States General. Pomer and Jennish, claiming to be the freighters, are only young men and do not usually trade for themselves, but on commission for others, 'or at least' not in such large quantities on their own account. Charterparty dated 15 December 1671 between Pomer/Jenins and Grantham to lade brimstone at Cesanatico. Before this, Harmans agreed a contract with Prince Pamphilio (Prince or Governor of the area) for Dutch subjects only to have the monopoly of the brimstone export trade there. Francisco Benveniti, consignor of the brimstone, was the factor of Harmans or other Dutch subjects. Lunenchusen and Capellen were factors there, procured the brimstone laden in Industry, and altered the bills of lading. Papers found aboard show that Power and Jennis sent no orders for payments at Cesanatico and Bari. Hamburg as the destination port was a fiction - the brimstone was for Amsterdam. Grantham made double bills of lading. Gerard Weymans, acting for Power and Jennis, was born in the Dutch Republic and is a Dutch subject.
