Folios 415-416: Joshua Sydney Horton, Regulating Officer, Liverpool. Encloses a letter [not present] from John Smith, a substitute, to Lieutenant Clarke. He was sent on board HMS Princess but was swindled or defrauded out of the greater part of 16 guineas by Peter Regan, who keeps a Public House lodging seamen and is a crimp. When Smith was sent on shore by Captain Colquitt at Captain Horton's request, to appear against Mr Regan, Lieutenant Evans ( Lieutenant Clarke being indisposed) applied at the Exchange for statements. A Constable was sent to arrest him, but the Magistrate decreed that a Civil Prosecution was most appropriate, and Captain Horton instructed Lieutenant Evans to call upon Mr Ellames, the Solicitor, who declined to take up the case without an Order from the Navy Board. On Lieutenant Evans return, Mr Regan was set free. Captain Horton requests an order to the Solicitor to prosecute Peter Regan for the fraud against Mr Smith. Also requests instructions to Mr Ellames to defend Lieutenant Evans in the execution of his duty.
