Folios 52-53. Letter from William Rees, District Auditor to Viscount Courtenay, Secretary to the Poor Law Board. Request you draw the attention of the Board to the subject of law-bills of Lowndes and Co received from the Liverpool Select Vestry on 22 May 1850 and again on 19 July 1850. These bills were paid in January 1851 and will appear in the accounts to be produced for the ensuing audit. A large proportion of them are in respect of business done for the Liverpool overseers over a period of six years. It appears the question as to whether the Select Vestry could lawfully pay the bills is paramount and a legal opinion is needed and a case is being prepared for counsel. Concern expressed about the Auditor personally having to bear the cost of obtaining opinion and asks whether the case may be forwarded to the Board when prepared, requesting the opinion of Mr Archbold, Mr Tomlinson or Mr [Pashby] or other Crown law officer. Information that if disallowed the reasons will be taken to the Court. Anxious not to cause the courts to reverse his decision as will have future implications upon the relation of the overseers to the Liverpool Select Vestry which has been on an unsatisfactory footing ever since the passing of the Liverpool Select Vestry Act, 5 & 6 Vict.c.88. If the Board decide in the negative it is felt to be right to incur the expense personally but hope they will relieve him of the charge. Annotated: has this course been taken in similar cases? It is believed not. The Board cannot give any sanction to him consulting counsel in this case and certainly not undertake to pay the costs of the case he refers to. He must exercise his best judgement and decide according to what he considers to be the law. The statute provides an appeal against his decision and also provides an indemnity for him, against costs.
