Description

John Hughes late of Newport, Salop now of Llanfyllin, Montgomery, late Sergeant Major of the 28th regiment of Dragoons the eldest son and heir of Hugh Hughes of Pool in the Co. of Montgomery, sadler and afterwards of Ty ucha in Myvod by Margaret his wife before their marriage both now deceased. 2 Griffith Evans of Kyffin in the parish of Llangadfan, farmer.

(1) Consideration 5/- for the term of one year.

Lease of land situate on Alltymain Common in the township of Penniarth in the parish of Myvod 15 acres and 2 roods and 28 perches number 72 in the enclosure map. Rent one peppercorn.

(2) 26 June 1819 (stitched to 448/162).

Preliminary recital of previous indenture 13.March 1741 William Griffiths grants the land to Magdalene Morris for the term of 500 years subject to the redemption on payment of £40. The equity of redemption becomes invested in Hugh Hughes deceased and his son John Hughes subject to redemption on payment of £300 and interest to John Davies farmer.

12 & 13 January 1796 lease and release between 1 H and J Hughes 2 Humphrey Gardner 3 John Williams and by virtue of a common recovery therein agreed Hugh and John Hughes gained the use of the land for ever for them and their assignes.

19 May 1796 Release made between Hugh Hughes 2 Thomas Downes 3 John Davies yeoman 4 Thomas Rogers. Land conveyed for the term of 1000 years subject to ceasing this term on the payment of £200 to Thomas Rogers.

5 John Owens land conveyed to Owen for the remainder of the terms of 500 years created by the 1741 indenture and Downes and Rogers assigned the remainder of the 1000 years created by the 1796 indenture.

28 June 1802 in an indenture between Hugh Thomas and Ann his wife and Griffith Evans it is mentioned that Owen by will bequeathed his interest to Ann Thomas and she having occasion for the principal sum of £500 secured to the said John Owen she applied to Griffith Evan and he agreed to advance the sum upon an assignment of the mortgaged premises. By an act of 1811 the land after to be mentioned was awarded to John Hughes in right of the messuage previously mentioned.

Now Richard J. Davies has agreed with John Hughes to purchase this land and Grffith Evans agrees to become a party to release the land from the mortgage.

Now in Consideration of £90 by Davies to Hughes and 5/- by Davies to Evans RELEASE of that land on Alltymain Common in Penniarth Myvod No.72 on the map bounded by R. J. Davies allotment and on the west by that of Sir Watkin Williams Wynn. To have it freely without encumbrances. Clause of Warranty.
