2. Whereas by indenture of lease and release
September 29th 30th 1789, between Thomas and Edward Butler 1st part, John Butler (eldest son and heir of Richard Butler of Priest Weston, deceased) 2nd part Humphrey Sandford and Elizabeth his wife, 3rd part Folliot Sandford 4th part, Edward Sandford, 5th part, Edward Harries esq 6th part, John Scott draper and Rev. Edward Blakeway clerk 7th part, all tithes of corn, grain,hay and herbage in the Isle granted and released to John Scott and Edward Blakeway; upon trusts on such trusts as Elizabeth Sandford should appoint in will, in presence of three witnesses. Elizabeth Sandford by virtue of such power, appointed to Humphrey Sandford her husband all tithes for his life, after decease to John Scott of Bromley, Kent for 500 years, upon trust that John Scott shall raise by mortgage of tithes and hereditaments, sum not exceeding £1000 to the use of Edward Sandford if he should return to England, and subject thereto tithes to 4 daughters Elizabeth, Barbara, Susanna and Charlotte for term of longest liver in case they should die unmarried. On death or marriage of any daughter,share to survivors. After deaths or marriages of all tithes devised to John Amler of Cruckton for 400 years, upon trust that John Amler shall levy by sale of tithes and premises sum not exceeding £1000 and shall pay sum for absolute use of grandson Humphrey Sandford, son of Folliot Sandford, with power to John Amler to raise £1000 at any time during minority of Humphrey Sandford for his preferment in life, as much as shall remain undisposed of to grandson Humphrey Sandford for life, and after deceases of grandsons, to use of sons of them. Whereas by indentures of lease and release May 23, 24 1759 between Humphrey and Elizabeth Sandford 1st part Thomas Evans clerk 2nd part, Thomas Bayley gent since deceased 3rd part, 2 pieces of land called Upper Bottom piece, or the Feggy piece, and the Lower Bottom piece in the Isle of Up Rossall were released to Thomas Evans upon several uses and trusts, to the use of persons that Elizabeth and Humphrey Sandford should appoint, in default of which to the use of Humphrey for life, after decease to the use of Thomas Bayley for 500 years with several remainders over: that Thomas Bayley should, out of rents and profits of land by sale or mortgage raise £600 and apply same to such persons and for trusts as directed by Elizabeth Sandford. By virtue of above indenture, Elizabeth Sandford, in presence of 3 witnesses, released to Edward Harries £600, upon trust that he should after the decease of Elizabeth and Humphrey Sandford cause executors of Thomas Bayley to raise by mortgage of pieces of land, £600 to be divided in equal shares between daughters Elizabeth, Barbara, Susannah and Charlotte; Humphrey Sandford and John Newling of Upper Berwick clerk joint executors of will, 5 guineas to be distributed among poor housekeepers of Bicton.
