Description

Of orders and depositions from records of Court before the Council in the Marches of Wales, in dispute between John Modlicote (plaintiff) and George Hickes, John Hickes and Thomas Wilkes (defendants).

Plaintiff claimed common of pasture and estovers, appurtenant to his meese place and 40 acres land, upon Whitecotes Wood and Brason, and alleged that defendants "with force and strong hand with mastiff dogges expelled and chased the said plaintiffes Cattells out and from the said two parcels of land and dyd hurt beate and evill intreate the plaintiffs said Cattells".

Defendants had replied that they had possession of ¼ of Whitcote Wood and 1/8 of Brason by conveyance from Sir Edward Litleton, knight, and conveyed these to Richard Powell, to whom they were tenants at will at the time of ejection.
