Complaint, William Brown of Stretton in the Field esquire orator that Hugh Adcock the younger late of Market Bosworth, county Leicester, gentleman deceased, about 1709 borrowed £600 from the orator, and mortgaged to him on 6, 7 March 1709/10 in deed between Hugh Adcock the younger of Market Bosworth mercer and Anne his wife, Hugh Adcock the elder of same ironmonger and 2. Brown, messuage late in the tenure of Samuel Mather and then in possession of Thomas Pelcher, closes called the Backside, the Brott Close, Short Harnells, Long Harnells, Ballards Close, Kirby High Way Close, Middle Field, Rowmill or Reynold Field in Cadeby or Cateby, county Leicester, about 100 acres; that Hugh Adcock the younger died October 1718, Anne his wife, Hugh the elder are dead, and Richard is the eldest son of Hugh the younger; £600 and arrears of interest are unpaid; the orator wished to deliver declarations of ejectment for recovery of possession of the mortgaged premises but had discovered that Hugh Adcock the younger had mortgaged the premises to Francis Mundy of Osbaston, county Leicester, esquire deceased prior to the said mortgage made to orator, and Mundy in his life and his executors since were in possession of the premises; further Thomas Astley late of Odson, county Leicester, gentleman deceased in his lifetime pretended that Hugh Adcock the younger on 29 December 1709 demised to Astley for £450 all the premises above named to be in the tenure of Pelcher for a term of 500 years as a mortgage; that executors of Astley and Mundy combined with Richard Adcock refusing to make known their mortgages to Brown.
