Description

Report of Alan Chambre on 3 individual petitions (James Bennet, W. Garret, late High Sheriff of Hampshire and John Blackburn) and 1 collective petition (9 people, including the Mayor of Penzance and the Mayor of Marazion, Cornwall [including mayoral seals], the prisoner's former employer, magistrates and tax officials) on behalf of James Martin, shopman and journeyman to John Mitchell, indicted at the Cornwall Lent Assizes for the theft of linen, muslin, cambric and other materials from John Mitchell, mercer of Helstone [Helston], from his dwelling house in December 1807; he was found not guilty of the capital charge of stealing to the value of 40/- from the dwelling house. Evidences supplied by John Mitchell, Richard Bennett, constable; John Borlase, Helston Town Clerk and Walter Reed, previous employer of the prisoner. There is a certificate of good behaviour from Thomas Thompson, Captain of the Captivity hulk at Portsmouth; and a covering letter to the certificate from Thomas Rouse. Grounds for clemency: previous good character, is truly penitent, has a certificate of good behaviour from W. Garret, late High Sheriff of Hampshire and good behaviour whilst on board the Laurel hulk at Portsmouth and other very respectable people have promoted his appeal. Initial sentence: 7 years transportation. Recommendation: speaks against mercy. Folios 3-17.
