Nature of request
The petition states that when, in the time of the King's father, after the death of John Comyn who held of the King in chief, his lands were taken into the King's hand in wardship, certain lands, notably the manor of Henshaw and the forest of Lowes, were forgotten; so that another inquisition was ordered by the present King, which found that these lands had been omitted. A writ was issued to take them into the King's hand, but it was not put into execution because the Earl of Atholl claimed free tenement in them after the death of his father. He was answered that he could have no claim, and that his usurpation of the lands did not give him one, but despite this, a writ was issued to halt the taking of the lands into the King's hand, and he is suing to annul the King's suit and the inquisition in favour of the King. The petition asks that the King might be advised of this, and that he might order the Chancellor to make execution of the inquisition, so that the King may have his seisin after the death of his tenant, as is right, and the person or persons who have a right in them may then sue them out of his hand in due form. It also notes that the inheritance of John Comyn should be divided among parceners, the Earl of Atholl and Richard Talebot: so that it is also to Richard's disinheritance if the Earl is allowed to occupy part of the inheritance before a proper division has been made in Chancery. Richard therefore asks that the lands might be taken into the King's hand and delivered to those who have right in them by process of law.
