Description

Report of S. Lawrence [Soulden Lawrence] on 2 individual petitions (the Very Reverend Arthur Onslow, Dean of Worcester; and the prisoner) on behalf of Jane Pain/Jane Paine, tried (with Jane Every/Jane Avery, Richard Dutton and Diana Dutton for stealing; and Jane Woodward, for receiving the stolen goods, knowing them to be stolen) at 'the last' Worcestershire Assizes, for the theft of 47 yards of silk, value £4, property of Ann Smith, on 11 December 1802. Jane Every is stated to be the wife of Jonathan Every, Jane Paine the wife of George Paine, Diana Dutton the wife of Richard Dutton and Jane Woodward the wife of Edward Woodward. Evidences supplied by Ann Smith, stallholder at Bewdley Fair; James Barber, shopkeeper; and John Smith. Onslow suggests in his petition that Paine's sentence be commuted to 12 months hard labour (or any shorter time.) There is a memorandum on the transmission of petitions and a note that a letter has been sent to the Duke of Cumberland regarding the case. Grounds for clemency: age (54 years), has 5 infant children, first offence, has lived locally for many years, previous good character, did not steal the cloth but that the others stole it. Initial sentence: Jane Every, Richard Dutton and Paine, guilty, 7 years transportation (Diana Dutton and Jane Woodward, acquitted). Recommendation: should receive same mitigation as the other 2 prisoners should any mercy be shown to them. Folios 127-134.
