Description
Petitioners
James Daudeleye (Audley).
Name(s)
Daudeleye (Audley), James
Addressees
King and council.
Nature of request
James Daudeleye states that when he was in the wardship of Roger le Mortimer, by reason of his minority, Roger made him make a recognisance for 10000 marks, so that after Roger's death a scire facias was issued, demanding that he give any reason he had why this sum should not be levied from his lands and chattels, as goods belonging to Roger and forfeited to the King. And the Sheriff of Staffordshire returned that he had informed James when he had not, so that execution was awarded against him. When James became aware of this wrong, he petitioned parliament at London, stating that he had been under age when he made the recognisance, but the King and council did not want to receive his averment, but ordered the Chancellor and Treasurer to examine the inquisitions held after the death of Nicholas Daudeleye, his father, and that if they found that he was under age, to discharge him of this sum. This was found to be so, but nothing has been done. He asks the King and council to order the Chancellor and Treasurer, that, having examined the inquisitions and found that he was under age, they are to proceed to judgment.
