Description
Petitioners
Thomas Beauchamp, Earl of Warwick; Robert de Clyfford (Clifford).
Name(s)
Beauchamp, Earl of Warwick; de Clyfford (Clifford), Thomas; Robert
Addressees
King and council.
Nature of request
The petitioners state that the Earl of Warwick holds the manors of Barnard Castle and Gainford, and Robert de Clyfford holds the manor of Hart, which are between the rivers Tyne and Tees and which were forfeited in war by John de Balliol and Robert de Bruce, respectively, of the gift of Edward I, but that Louis, Bishop of Durham, in the King's first parliament, demanded foreitures of war between those rivers, and claimed the entire area as his royal franchise, through the charter of Henry III, a copy of which is sewn to this petition, for the manor of Greatham, as being within his franchise of the Haliwerfolc - although it is not, but in the wapentake of Sadberge. And through this he has been granted forfeiture of war in the franchise of Haliwerfolc, which he claims is the entire area between Tyne and Tees, although it does not include the wapentake of Sadberge, in which the manors of Barnard Castle, Gainford and Hart are located. They ask that these things might be examined, and that a writ might be sent to the Bishop to cease a suit on this that he has begun in his own court against Robert de Clyfford concerning the manor of Hart.
Nature of endorsement
Coram rege et magno consilio.Because the Bishop's petition has been answered that they are to go ahead in the plea, provided that they do not proceed to judgment without consulting the King, they are to aid themselves by response in the said plea as best they can.
