Description
Petitioners
John de Wytele (Whitley).
Name(s)
de Wytele (Whitley), John
Addressees
King and council.
Nature of request
John de Wytele makes three complaints against the Prior of Tynemouth, and requests a remedy:1) He states that he holds certain lands in Whitley Bay of the Prior of Tynemouth, but that Adam, predecessor of the present Prior, seized them into his hand after the death of Henry de Wytele, John's father, although they are not held in a way that gives wardship or marriage, and Adam and his successors held them until John was past the age of 22 years, and then charged him a relief which equalled the value of the lands for two years.2) He states that the Prior is preventing him from doing justice in matters concerning his villeins; and also that when he granted John de Redeburn, a monk of Tynemouth, 100 cartloads of marl from his land, the monk took 400 cartloads. And the Prior has done nothing to punish this.3) He states that when he brought a writ of mort d'ancestor against William, the predecessor of the present Prior, before John de Vaus and his companions, justices in Eyre in Northumberland, the Prior claimed that he should have return of writs as part of the franchise granted him by the King. And when the day given him by the justices arrived, John could have no writ because it had been made away with by the Prior. And after that he did not dare to purchase another writ or pursue his right while he was under age.
Nature of endorsement
John de Wytele shows the King, for the King, that the Prior of Tynemouth has disinherited the King both by land and by sea, as in wreck and in vills, to the sum of 500 marks and more, and has disinherited the people of the country, through the franchise which he has from your ancestors and from you, as he says.
