Nature of request
Mary de Preston, nun of Wilberfoss, states that she had inherited some land in Swaythorpe, which she rented to her closest kinsman, Gerard Salvayn, for term of her life, for a rent of 10 marks annually. Gerard gave her his deed for this, which she gave into the keeping of John de Walkyngham. When Gerard heard that John had the deed, he extorted it from him by threats and harsh treatment, and since then has withheld the rent, so that she has only received 5 marks in the last fourteen years. She requests a remedy.

She is to have a writ in the name of the Prioress and monastery against Gerard and John, for conspiracy, for a deed removed in such a way, formulated for her case: as in a new case a new remedy is to be provided, according to the statute.

Dated on the guard to '? 1307-1320' with reference to CFR 1319-27 p.18 (an order to take some lands held by Gerald Salveyn into the King's hand, after his death) and CPR 1313-7 p.249 (a commission to inquire into malpractices by Gerard Salveyn when Sheriff of Yorkshire, dated 26 Fenruary 1315), though these entries are not related to this case. Gerard Salveyn was Escheator north of the Trent between 23 May 1308 and 10 December 1309, and was Sheriff of Yorkshire between 5 March 1311 and 1 October 1314. He was dead by 13 March 1320 (CFR 1319-27 p.18). Although another Gerard Salveyn was Sheriff in 1349-50, the hand would suggest a date in the reign of Edward II.
