Description
Petitioners
Thomas de Marlebrige (Marlborough).
Name(s)
de Marlebrige (Marlborough), Thomas
Addressees
Council.
Nature of request
Marlebrige shows that he has arraigned an assize of novel disseisin before the justices in Somerset against the Fyenles and Say and others of tenements in Westcombland. Say made a false allegation to the king that he had purchased the tenements without the king's licence from John de Fyenles who held it from the king in chief, when he did not hold it from the king but from the lands of the Templars and then delivered to the Hospitallers in pure and perpetual alms. By which allegation the king sent his letters under the privy seal to Hughelyn and Hyneton to take the tenements into his hand, and to the justices to surcease the taking of the assize, by which the assize was delayed against common right.
Nature of endorsement
Because it is agreed that the common law should not be delayed by any order under the great seal nor under the privy seal, it is ordered to the justices that if any such order comes to them, that they should not stop the matter at all but do what is to be done at the common law and by reason.
Places mentioned
Westcombland, Somerset.
People mentioned
Robert Selyman, justice of assize in Somerset
John de Fyenles
Isabel [de Fyenles], wife of John de Fyenles
John de Say
George Hughelyn
William de Hyneton
Templars.
Note
There are no references to help date this petition. It is likely to be early Edward III, because Marlebrige seems to have been an adherent of the Despensers, and was not formally restored to favour until 27 July 1327 (CPR 1327-30, p.160).
