Nature of request
Richard de Berners states that he arraigned an assize of novel disseisin before Gilbert de Roubirs and his companions, against John, son of Edmund de Berners and others, concerning tenements in West Horsley and adjoining vills in Surrey, and that this assize, because of certain difficulties, was adjourned to the Bench. It is still pending there, and has been for two and a half years. He requests that the king ask the justices to proceed in that plea without delay, according to the process made before them, and to do swift justice to the parties. And if there is some difficulty which prevents them from doing this, that the record and process might be sent before the king.

The justices are to be ordered to proceed to determine that business, as swiftly as they can according to the law and custom of the realm, without that clause 'And if there is any difficulty etc.'

The date is given on the guard as '? 1319-24, cf. preced. (which is probably earlier), and Pat. R. p.607'. CCR 1317-1321 p. 607 is dated at Westminster, May 16 1321, but seems to be the association of two justices in an assize, rather than an adjournment to either bench, so probably precedes the adjournment.If the adjournment took place soon afterwards, however, and the petition has been delayed there for two and a half years, that would date this petition to c. 1324. It is hard to tell whether it is earlier or later than SC 8/8/375: in terms of hand it is impossible to tell, and in terms of subject-matter they seem to be at a roughly similar stage of the proceedings, each giving slightly different details. SC 8/8/375 specifically mentions William de Bereford as one of the justices before whom the case was adjourned: he sat on Common Bench until 1324(Selden Society vol. 55, Select Cases in the Court of King's Bench: Edward I, vol. I, p.cxli), which would again suggest a date around then.
