Nature of request
Herbert de Mareis states that he lately recovered Lundy Island against John de Wylinton, before John de Foxle and his companions, justices appointed to hold assizes in Devon, but that before he could have execution of that judgement, the king spoke to him about exchanging the island for other lands - about which nothing has yet been done. Herbert requests either execution of the judgement or lands in exchange.
Nature of endorsement
He is to sue a writ in Chancery to the justices to have the record and process of the assize brought there, and he is further to state there if the island is in the king's hand or John's; and if in John's he is to sue a judicial exception; if in the king's, or someone else's of the king's gift, it seems to the council that the king ought to hold to the agreement.

Note
This petition must date from after SC 8/7/338, which can be dated to 1322, but there is no suggestion that the king is not Edward II.CPR 1321-4 p.183 is dated at York, 20 July 1322, and CCR 1323-7 p.622 is dated at Ledbury, 3 December 1326. From these references it would appear that Herbert de Mareys never regained possession of Lundy in Edward II's reign, although there is no evidence of lands given him in exchange.
