Nature of request
Robert and Margery Broun state that Thomas de Asshewell and Robert de Pipherst, as executors of William Broun, sued out an execution of a recognizance of 50 pounds, made to Thomas by William Broun before the mayor of London. Robert and Margery, tenants of William's lands, came before the aforesaid justices in the eleventh year of the reign of the present King Edward, and put forward a quitclaim which was rejected by the aforesaid executors, and on this they put themselves on the country. The process continued until the thirteenth year of the king's reign, when the executors lost their suit. Afterwards the executors sued a new certification before the mayor of London, returnable in Chancery, through which they had a writ to seize William's body, returnable before the aforesaid justices, as if the original suit of debt had never taken place. It was answered that William was dead, because of which the court adjudged that the executors should have execution of the 50 pounds, and all the lands and tenements that William had on the day on which the recognizance was made. Robert and Margery were never summoned for this last suit, and knew nothing of it until they were expelled from their tenements by eighty armed men. They request a remedy.

The justices are to be ordered that if there is an error in the delivery of the tenements etc, they are to correct it etc. calling anyone necessary etc. and that they are to do justice to the complainants on the contents of the petition etc. as justice demands.

Note
One of a collection of petitions published on pages 387ff of Rot. Parl., vol I., which all seem to date from around 1322. This dating is confirmed by PROME, Appendix of Unedited Petitions, 1307-1337, Rotuli Parliamentorum I, pp. 387-415, which dates these petitions to 15 or 16 Edward II (1321-1323).
