(i) Obligation by Alexander Young, merchant, burgess of Stirling, concerning a debt of £840 Scots for 'merchant wares' bought from Andrew Oswald, merchant, burgess of Edinburgh [cf. f.183]. Young contracts to pay the full sum to Oswald, his heirs, executors or assigns by 1 February 1649, together with £100 'expenses' in case of default, and the statutory interest for any period after the agreed date during which the debt remains unpaid. He agrees to have the obligation registered in the books of council and session or the town court books of Edinburgh, to have the force of a decree allowing for the penalties of horning, etc., and appoints [blank] his procurators. The two witnesses named are Oswald's son James and a servant, also called Andrew Oswald. [Signed by] Young and the witnesses. Three notes [in different hands]: Edinburgh, [?]13 October 1648. (ii) 1. Young's procurator [unnamed] appeared and consented to the registration. 2. 'Primo Nor.'. 3. 'Thr restis only of this band ...' [illegible word]. [Endorsed, in yet another hand]: Names of parties, date of obligation and amount of money concerned. undated
