Description

(i) Obligation of Archibald Porterfield (Portourfeild), burgess of Edinburgh, to James Davidson, keeper of the Tolbooth in Canongate. Porterfield acknowledges that he owes Davidson £155. 14s. Scots for his 'furnishing and Interteinnement' while a prisoner, and contracts to pay it by 1 March next, together with £100 'expenses' in case of default. If the money is not paid by the agreed date he promises to renew the bond, finding one or more satisfactory sureties or, if no such can be found, to invest Davidson, his heirs, executors and assigns with a house in Edinburgh or a house and biggin [outbuilding; dwelling place or gentelman's seat] in Leith. In the event of failure he contracts to pay the usual interest until the whole sum is paid. He agrees to have the obligation registered in the books of council and session, to have the force of a decree allowing for the penalties of horning, etc., and appoints [blank] his procurators. The document was written by James [? Grameslaw/Graineslaw], clerk at Morebattle. Three witnesses [named], including [? Grameslaw]. [Signed by] Porterfield, [? Grameslaw] and another of the witnesses, Alexander Wauchope of Stottencleuch. [Endorsed, in two different hands]. Morebattle, 16 February 1646. (ii) 1. Porterfield's procurator [unnamed] consented to the registration. 2. Names of parties and date [as in 1.]. Edinburgh, 30 March [?1646]
