WEHNER, Max Herman v. The King. Wehner was charged in East Africa in 1904 with having murdered a native McHarnia by shooting. After being sentenced to death by an East African Court the sentence was commuted on appeal to penal servitude for life. From that judgment the defendant appealed to the Privy Council and the original verdict was quashed. The Attorney-General stated that the whole proceedings were from the first irregular. The Court which sentenced Wehner had a jury of only five persons and these did not in fact find the Plaintiff guilty of murder. A number of material witnesses were not called and evidence given was not verified.
