Description

Prisoner name: James Harling.

Prisoner occupation: Riding Officer of Excise.

Court and date of trial: Inverary Circuit Court, 13 September 1838.

Crime: Assault with intent to ravish. Victim, Isabella Gillespie, a licensed retailer of tobacco, 42 years old, unmarried.

Initial sentence: 12 months imprisonment.

Annotated (Outcome): 'Nil'.

Petitioner(s): The prisoner, enclosing supporting letter from his mother Alice Harling, of Kent Terrace, Kendal, Westmoreland, and character references from William M Wade, [John Evans Coller], [Alix Macpherson]. The prisoner, enclosing a letter he had sent to one of his 'persecutors' but which had been returned, refused. The prisoner enclosing a medical certificate from James MacNicol. Five other petitions from the prisoner.

Grounds for clemency (Petition Details): The charge brought is fabricated, lacks evidence and is designed to discredit the prisoner because of his job; the victim tried to extort money from the prisoner; the prisoner has an unblemished character; the witnesses and the accuser are unreliable and have been guilty of perjury in the past; the prisoner is 'persuaded' he will be reinstated to his job once freed; the prisoner's health is declining in gaol; the prisoner offers money as a fine in lieu of the remainder of his sentence.
