Description

Prisoner name: Benjamin Gould and William Wilkinson.

Prisoner age: Gould 19 years. Wilkinson 25 years.

Court and date of trial: Staffordshire Quarter Sessions, January 1838.

Crime: Housebreaking. Stealing over 15/-, the victim Luke Gilbert, victualler of West Bromwich, Staffordshire.

Initial sentence: Gould ten years transportation. Wilkinson 15 years transportation.

Gaoler's report: Gould: 'Character Bad. In prison before for an Assault.' Wilkinson: 'Convicted before'.

Annotated (Outcome): Gould: 'Nil'. Wilkinson: 'Nil'.

Petitioner(s): Gould: John Gould, the prisoner's father of New Street, Walsall, Staffordshire, undersigned by 24 supporters. Wilkinson: John Prince, foreman of the jury, undersigned by 32 supporters; William Wilkinson, his father.

Grounds for clemency (Petition Details): Gould: The prosecution witness is unreliable and possibly induced by a reward; the prisoner did not have full legal support at the trial due to unforeseen circumstances; the prisoner has never been accused of a felonious act before; the prisoner is young. Wilkinson: The prosecution evidence was not sufficient to convict the prisoners and some jury members were unhappy; the prosecution witness is unreliable and possibly induced by a reward; the prisoner is an only child of good character, with a respectable father; none of the stolen property was traced to or found on the prisoner.
