Description

British New York Vice-Admiralty Court.

Captured ship: Wasp (master Pablo Ferrer).

Capture history: a Spanish merchant ship under American colours (brigantine, 120 tons, 12 guns, 8 swivels, 25 men, formerly a British Jamaican privateer taken by Americans), now bound from Brunswick, North Carolina to Edenton, Virginia, laden with Havana sugar and tar; taken on 9 July 1780 off Cape Henry by HMS Richmond (Charles Hudson commanding), and HMS Camilla (John Collins commanding) and brought into New York.

Intended voyage: within the United States.

Court papers numbered CP 1-6:-

  • [CP 1]: affidavit of papers brought in by the prize master John Clyde, purser of HMS Richmond, 24 July 1780 ;
  • [CP 2]: libel in Advocate General at the relation of Hudson v The brigantine Wasp and her cargo, 24 July 1780;
  • [CP 3]: monition, 24 July 1780;
  • [CP 4]: answer and claim of John Hilton and Thomas Brain, merchants of New York, on behalf of Thomas Hill of Jamaica, owner of the loyalist privateer Wasp (commander William Smith), taken by the American privateer General Moultrie in September 1778, and brought into Beaufort, South Carolina, 9 August 1780;
  • [CP 5]: replication of the Advocate General v Hilton and Brain, reclaimants.
  • [CP 6]: deposition of Pablo Ferrer, of Barcelona, 11 August 1780;

[Decision: condemned, if no response to the monition by 13 August 1780]
