Description

British New York Vice-Admiralty Court.

Captured ship: Warrior (master Jacob de Hart).

Capture history: an American merchant ship with a letter of marque (100 tons, 12 carriage guns, 50 men) bound from Philadelphia to Cap François, Saint Domingue, laden with flour, taken on 27 August 1782 at Cape Henlopen by HMS Quebec (Christopher Mason commanding), HMS Centurion (Samuel W. Clayton commanding), HMS Vestal (Richard Fox commanding), HMS Bonetta (James Cotes commanding), HMS Belisarius (Richard Graves commanding) and the privateer Digby (Lawton commanding) and brought into New York.

Intended voyage: from the United States to the Caribbean Islands.

Court papers numbered CP 1-4:-

  • [CP 1]: affidavit of papers brought in by the prize master William Ferguson, master's mate of HMS Quebec, 5 September 1782;
  • [CP 2]: libel in Advocate General at the relation of Mason v The sloop Warrior and her cargo, 6 September 1782;
  • [CP 3]: monition, 6 September 1782;
  • [CP 4]: deposition of Jacob de Hart of Philadelphia, 7 September 1782.

[Decision: condemned, if no response to the monition by 27 September 1782]

Ship's Papers numbered SP 1-6 (Pennsylvania papers):-

  • SP 1: ship's register, Philadelphia, 14 August 1782;
  • SP 2-SP 3: bills of lading;
  • SP 4: clearance from Philadephia, 14 August 1782;
  • SP 5: printed privateer commission, with a description of de Hart on the reverse, 20 August 1782;
  • SP 5: printed instructions of Congress, 7 April 1781.
