Description

British New York Vice-Admiralty Court.

Captured ship: Rifleman (master Major Lyons).

Capture history: a American merchant ship (sloop, 45 tons, 6 men, who all escaped except the mate) bound from St Croix, Danish West Indies, to New Haven, Connecticut, laden with rum, sugar, molasses, rum, salt; taken on 19 November 1778 in latitude 41°N, longitude 73°W by the loyalist privateer Swift (James Hyatt, junior, commanding), and brought into New York.

Intended voyage: from the Caribbean Islands to the United States.

Court papers numbered CP 1-5:-

  • [CP 1]: affidavit of papers brought in by the prize master Charles Thomas, first lieutenant, 1 December 1778;
  • [CP 2]: libel in Hyatt v The sloop Rifleman and her cargo, 1 December 1778;
  • [CP 3]: monition, 1 December 1778;
  • [CP 4]: deposition of Ebenezer Smith, born Long Island, New York, 8 December 1778;
  • [CP 5]: answer and claim of Isaac Youngs of Cold Spring, Suffolk County and Nassau County, miller, Long Island for himself and on behalf of John Hewlet junior of Queen's County, George Youngs merchant of Cold Spring, and Israel Youngs of Cold Spring, Queen's County, yeoman

[Decision: condemned, if no response to the monition by [29] December 1778].
