Description

British New York Vice-Admiralty Court.

Captured ship: Little Tom of Newfoundland (master Richard Henley).

Capture history: a Newfoundland merchant ship (sloop, 30 tons, 4 men) bound from St Lucia to St John's, Newfoundland, laden with sugar; taken 30 April 1782 by the American privateer Wilkes (William Cunningham commanding), retaken on 16 May 1782 off Cape Henry, Virginia by HMS Carysfort (William Peacock commanding), and brought into New York.

Intended voyage: from the Caribbean Islands to North America.

Court papers numbered CP 1-3:-

  • [CP 1]: libel in Advocate General at the relation of Peacock v The sloop Little Tom and her cargo, 5 June 1782;
  • [CP 2]: answer and claim of John Power, supercargo, on behalf of Elliott Elmes, of St John's Newfoundland, 6 June 1782;
  • [CP 3]: replication.

Ship's Papers numbered SP 1-6:-

  • SP 1: invoice of cargo, for 44 hogsheads of sugar, 20 April 1782;
  • SP 2: crew list and agreement, 20 April 1782;
  • SP 3: clearance from St Lucia, 20 April 1782;
  • SP 4: clearance bond, St Lucia to Newfoundland, 20 April 1782;
  • SP 5: manuscript privateer commission of the Wilkes (William Cunningham), owners Samuel B Cunningham & Co of Virginia, 22 October 1781, endorsed with the appointment of James Cordary as American prize master of the Little Tom, 30 April 1782;
  • SP 6: instructions of Captain Peacock to Thomas Hall, the British prize master of the Little Tom, to proceed to New York, 16 May 1782.
