Description

High Court of Admiralty.

Captured ship: Commerce (master David Martindale, prize master Jacques François Boux of Dunkirk).

Capture history: a British ship (1 gun, 2 Englishmen and 6 Frenchmen after first capture) bound from Memel, Russia to Workington, laden with timber and planks; taken on 10 August 1779 about 10 leagues west of Christiansand, Norway by the French privateer La Revanche (Jacques Perre commanding), retaken on 17 August 1779 about 2 miles from Ostend by HMS Rambler (James George commanding), and brought into the Downs.

Intended voyage: from Russia to England.

Court papers numbered CP 1- CP 5:-

  • [CP 1]: attestation as to papers, 19 August 1779;
  • [CP 2]: standing interrogatories, one deposition taken at Deal, commissioners affidavit, 21 August 1779;
  • [CP 3]: attestation and claim on behalf of John Elwood of Workington, Cumberland, the owner, 23 September 1779;
  • [CP 4]: allegation on behalf of the captor, 8 October 1779;
  • [CP 5]: translation of the commission of La Revanche, 10 December 1778, annotated with appointment of Boux as prize master, 10 August 1779.

[Decision: probably restored, paying salvage].
