Description

Folios 151-152: William Case, 5 Vauxhall Street, Vauxhall. Requests reimbursement of his expenses of £21 15s 3d which were incurred in a trial in the High Court of Civil Jurisdiction and High Court of Appeal in New South Wales on behalf of the Crown. Documents relating to the case having been delivered to the Admiralty December 1814.

Note: The following documents relate to the case of Garnham Blaxell -v- William Case, then Captain of HMS Samarang, during 1812-1813. The case relates to the price of provisions supplied by Mr Blaxell which Captain Case considered to be above market price and the price at which they could have been supplied by HM Stores in Sydney. Governor Macquarie had refused to provide supplies from HM Stores as it was not usual for ships of war to the supplied from the Stores and referred Captain Case to Mr Blaxell. Captain Case offered to pay the difference between Government prices and those charged but Mr Blaxell refused to accept the offer. The Samarang first arrived in Sydney on 26 September 1812, left on 7/8 January 1813 but returned on 8/9 January, due to weather conditions, not leaving until 8 April.

Folios 163-169: enclosure with folios 151-152. Copy of Respondent's Reply/Statement in the High Court Appeal in case of Blaxell, Appellant and Case Esq, Respondent. 1813 September, Judge affirmed Appeal dismissed.

Folios 170-173: enclosure with folios 151-152. Extract from Proceeding in the Court of Civil Jurisdiction held at Sydney on 13 July 1813. Cause No. 226. Garnham Blaxell of Sydney, Plaintiff and William Case, Commander of HMS Samarang Defendant. Plaintiff appeared by his agent, George Crossley[?]. Henry Williams, Purser of HM Samarang. William Broughton, Acting Commissary for Territory, Simon Lord and George Cribb, a butcher, also gave evidence as did Simon Lord. Reference made to Captain Jeffreys of the merchant ship Archduke Charles and how his meat was supplied. John Hoskins of the Orphan School at Sydney states the price he pays for provisions. Document signed as a true copy by Ellis Bent, Judges [?].
