Folios 256-257: Thomas Baker, HMS Cumberland, Downes. As apprized by the arrival of HMS Malacca, confirms that Luke Spencer and Stephen Baker, Marines under sentence of death were ordered to England on board HMS Cumberland by Vice Admiral Sir Charles Tyler, Commander in Chief at the Cape of Good Hope. Asks for instructions on the disposal of these 2 marines, who are currently part of the ship's complement and also if they should be discharged to the supernumerary list from the date of sentence.
