Folios 222-223. Letter from Thomas Watkins, Clerk to the Guardians of the Cardiff Poor Law Union, to Poor Law Commission, replying to their letter of the 25 October 1844 requiring more precise information as to the state of the proceedings against the sureties of the late collector of the poor rates for Landaff [Llandaff]. Forwarding a copy of a letter from E P Richards, Solicitor to the board. Enclosed is a letter from E P Richards to Thomas Watkins, Clerk to the Guardians of the Cardiff Poor Law Union. In reply to his letter of the 4 November 1844 requesting as to the state of the proceedings against the sureties of Richard Davies namely William Evans and George Coleman. Last June [1844] an action was brought against them at the suit of the guardians of the union and that a declaration was filed on the 28 June 1844. On the understanding with the parish officers of Landaff [Llandaff] and the board that £50 should be received from Coleman in discharge of his liability under the bond. He did not appear to the action and judgement was signed against him. On the 17 July 1844, replication was filed but a few days afterwards I was informed that Evans proposed paying a sum checkly and was directed stay further proceedings, it being doubtful whether Evans would be able to pay any portion of the debt or costs if the case proceeded and a verdict was given against him. Annotated: the law should be allowed to take its course against the sureties forthwith. G C [George Coode, Assistant Secretary to the Poor Law Commission]. Coode thinks under the understanding on which the verdicts were taken nothing can be done against Evans after the receipt of the £50. As regards the second surety it would be a harsh and unusual course to take out [a prosecution] against him. If he pays [instalments] accordingly to the agreement [on] which the verdict was taken.
