Folios 232-233. Draft letter from the Poor Law Board to Thomas N Firmin, Clerk to the Guardians of the Southampton Incorporation, referring to his letter, dated 13 November 1856, which requested opinion on the duties of overseers and collectors of poor rates with reference to the keeping of accounts. Answers are as follows: Overseers are not required to keep a book of accounts but, by acts of 4& 5 William 4 c 76 s 47 and 7& 8 Vic c 101 s 38, they must render half-yearly accounts to the auditor in their own names, adopting any suitable form of account. However, if the accounts warrant it, the board will issue an order requiring them to keep a book of receipts and payments. Overseers have no legal authority to call upon collectors to keep the accounts of the overseers. Before expressing opinion on whether overseers can require collectors to make returns ordered by parliament or the board, Firmin is requested to give facts of some particular case where the question arises.
