A recommendation of the Court of Quarter Sessions of the County of Derby Epiphany Sessions January 1827 in favour of Abraham Smith and John Birkinshaw. Smith convicted of assault with intent to commit a rape (victim Hannah Booth) and Birkinshaw an offence against the Game Laws. Extracts from the report of the visiting justices of the County Gaol and House of Correction to the justices of the County on the conduct of the prisoners. Smith: conduct greatly improved, made Wardsman: Birkinshaw: exemplary conduct during 18 months he has served. He has acted as turnkey and kept treadmill repaired. There are also 2 letters from W J Lockett Clerk of the Peace about the cases. Initial sentence: 2 years' imprisonment each. Annotated: Birkinshaw to be respited. Smith: Mr Peel does not perceive any special reason stated as a ground of mitigation and considering the pattern of the offence, he would not think himself warranted etc. etc. HN52
