The Matrimonial Causes Act 1967 provided for the setting up of a separate Rule Committee for the Matrimonial Causes Rules to be made under the Act. The membership comprised the Lord Chancellor, the President of the Probate, Divorce and Admiralty Division, one divorce judge, two county court judges, one registrar from the divorce registry, one county court registrar, two barristers who are members of the Bar Council and two solicitors, one of whom is to be a member of a local law society. Matters of procedure are governed almost exclusively by rules of court made under powers given by statute.
The committee, which is serviced by the Lord Chancellor's Department, considered amendments to the rules, memoranda prepared by interested parties, and reviewed and redrafted the rules. The rules that are made must be published and laid before Parliament. The rules are then submitted to the Lord Chancellor for his approval.
