Thomas Corbett. Messrs. Turnpenny and Cleve have applied for compensation for the loss of the Postboy cutter, then in the service of the Crown and taken by the enemy. We have not accepted liability because of the decision of a Court Martial, which laid the responsibility on the Master who failed to take actions to avoid capture. The owners state there was nothing in the contract about a Court Martial to decide liability and they were not responsible for what the Commander did. He was appointed on recommendation from Admiral Rowley Commander Vanbrugh says if the commander of the Postboy had let out the reefs of the topsail, as suggested by the Court Martial, it would have made no difference to the fate of the ship
