5. John Batty of Barbon, yeoman.

Recitals:- [WD WHLEP 4/T 28];

- Marriage settlement, 8 April 1823;

- [WD WHLEP 4/T 29-30] including above in recital;

- [WD WHLEP 4/T 32-33];

- Will of Catherine Grace Godwin made 23 December 1844 conveying all her real property to trustees named in [WD WHLEP 4/T 28] etc. should she die without issue and £55 . 9s. 8d. p.a. long annuities being residue of stock to use of trustees under [WD WHLEP 4/T 28] to pay rents in equal parts to husband Thomas Godwin and friend Mary Warboys for their lives or to such as they appoint, then to their survivors, then to such as Thomas Godwin appoints; should Mary Warboys die before Thomas Godwin, her interest to be conveyed to him;

- Death of James Cadwallader Parker 16 August 1840, buried 24 August at St Martins in the Fields;

- Death of Walter Henry Watts in January 1842, buried 11 January at Kensington;

- Articles of agreement, 26 March 1845

- George Stodart, at request of Catherine Grace Godwin, contracted with Joseph Gibson for sale of premises in Barbon [see below] for £4,995;

- Codicil of will of Catherine Grace Godwin, made 17 April 1845, entrusting said £4,995 to trustees named in will for them to invest and to pay yearly sum of £60 to Mary Warboys, with residue in equal parts to Mary Warboys and Thomas Godwin; should Mary Warboys survive Thomas Godwin, she is to receive whole sum whilst, after her decease, the capital to be transferred to Thomas Godwin;

- Death of Catherine Grace Godwin on 5 May 1845;

- Will and codicil proved 31 July 1845

Premises: Stoneders (3 . 2 . 28), Scaleber (2 . 3 . 32), Flatts (13 . 0 . 23), Far Mire Meadow (3 . 0 . 18), Mire Meadow (7 . 0 . 15), Potlands Pasture (5 . 3 . 3), Town End Field Pasture (5 . 3 . 12), Oakland's Pasture (5 . 0 . 24), Kiln Croft (1 . 0 . 16), Great Barn Rigg's Meadow (7 . 2 . 11), Bracken Barn Rigg's Pasture (2 . 3 . 11), Bull Copy (1 . 3 . 7), Christopher Croft Meadow (1 . 3 . 16), Wilson Parrock (0 . 3 . 13), Cocken's Parrock (0 . 2 . 21), Mire Meadow (2 . 0 . 22), Stocks Garth (0 . 0 . 36); Burnside cottage in occupation of Thomas Godwin with 2 cottages adjoining, in occupation of William Pool and John Burton; Cocken's House with barn, shippen etc., now made into 2 tenements in occupation of Ann Ellison and Aggy Holdpike; house called Heart of the Town with barn, stable, cow house etc.; 2 cottages called Chapel-fold in occupation of James Windle and Edward Crayston; barn and shippen behind Old Tithe Barn; pew in chapel no. 14.

- In Barbon, late in occupation of (3) and wife Catherine Grace and Edward Huggonson;

- To use of (4) for life without impeachment of waste, unless directed to other uses by (4); after determination of estate in lifetime of (4), to (5) for life of (4) in trust to prevent claim for dower by wife of (4); agreement of (4) that wife will not be entitled to dower.

Covenants include: (1) will produce upon reasonable request [WD WHELP 4/T 28], [WD WHELP 4/T 29-30], [WD WHELP 4/T 32-33].

Consideration: £4,995.

Witnesses: Henry Bois and Hw S Whiffin, clerks at the Bank for Savings, Montague Street, Bloomsbury, Margaret Harrison and John Winster, Barbon, T Eastham, solicitor, Kirkby Lonsdale and John Townson, his clerk.
