Description

Original will of John Davies of Allport in the parish of Churchstoke. gent.

He is engaged by his voluntary promise to pay Ursula wife of John Tomley of Broniarth in the parish of Guilsfield co Mont husbandman 40s a year, and charges his wife as executor with payment, out of the wife's share of the interest on £100 bequeathed to her to dispose of as she thinks proper among her children or grandchildren and her nephew Richard son of Ursula Tomley (Richard's share not to exceed £20), the 40s to be paid yearly during Ursula's life.

He has sufficiently provided for his eldest son, and therefore gives his youngest son (the other executor) £600 out of money secured to him by mortgages, with interest from the time of his death. He also gives his youngest son William Davies a further £100 out of the £300 which his eldest son by his marriage settlement has contracted to pay after John Davies' wife's death. He also gives William all his stock of slack or horned cattle, his horses and mares, implements of husbandry, carts, carriages and all horse geerings. He gives his youngest daughter Sarah Davies £400 with interest from the time of his death, to be paid out of the mortgages mentioned before, in case she marries with the consent and approbation of her mother and elder brother (or the survivor), if she neglect or refuse, then she and her husband shall only receive the interest for their lives and the principal shall be divided among her children if more than one, if one only, then to such child, if none she may dispose of the principal to some person of her own family, either brothers or sisters or their children.

He gives to his eldest daughter Margarett wife of John Downes of Churchstoke £100 to be paid immediately after the testator's death, if she is then a widow, the money shall be paid to her children or child.

He gives John and Margarett a further £100 (another part of £300 which is eldest son contracted in his marriage settlement to pay) to be paid immediately after the testator's wife's death, but if Margarett is then a widow, this is revoked and the £100 shall be divided among her children or go to an only child. He gives his 2nd daughter Mary wife of Griffith Pryce of Edenhope £100) residue of the £300) immediately after testator's wife's death; if she should be a widow, then the £100 to be paid to her children or only child; if no children, then the money shall be divided equally among such of her brothers and sisters as shall be then living.

He gives his sister Mary Rogers widow of Edward Rogers late of Llandrinio husbandman decd £3 yearly for life clear of all taxes etc. to be paid by his youngest son. He gives his wife the interest on £100 to enable her to pay the first mentioned 40s yearly, the residue to be for her own use. He declares that this £100 is part of £200 secured by bond from his eldest son to be paid to testator's executors after his death, and he empowers his wife to dispose of the sum among his children, grandchildren and Richard Tomley as she thinks fit (but not above £20 to Richard).

He gives his wife the necessary use of all household goods and furniture for life, with power to dispose of it after her death to his younger children William and Sarah in such proportions as she thinks fit.

The rest of his goods, cattle, chattels and personal estate at the time of his death he gives to his youngest son William.

1. An incomplete draft of the will, leaving William £600 of money now at interest and a further £100 which testator's eldest son is to pay at his mother's death; William to have all stock and implements. He gives Sarah £400 from money now out at interest. He gives John and Margaret Downes £100 at his death and a further £100 at his wife's death (sums charged on his eldest son's estate at Alport), the first £100 to be to their own use, the other to be shared between their children.

He gives Griffith Price and Mary his wife £100 to be paid at testator's wife's death, (money charged on his son's estate at Allport), and they are to share it among their children as they think fit.

He gives his sister Mary Roggers an annuity of £3 and charged William with payment, He gives his wife £100 charged with payment of 40s from the interest to her own sister Ursula Tomle for life, the rest of the interest to her own use for life, after to share the £100 among her children and nephew Richard Tomle or her grandchildren.

He gives his wife all household stuff to share between William and Sarah as she thinks fit, except such furnishings as she wants for her own life.

He leaves his wife 3 rooms in his dwelling house at Alportfor her life, the parlor, the parlor chamber and half the cellar and sufficient wood for firing. A proviso about his wife's remarriage not completed.
