Inquisition taken at Manchester 15 Octr. 15 Eliz. [1572] after the death of Raphe Rissheton (names of jurymen given).

The jurors say that Roger Ryssheton, father of the said Raphe, was seized of the Manor of Powtalghe & lands etc, in Churche, Rishton, Blakeborne & Oswoldtwysill. Recites a Recovery in Michaelmas 38 Hen.VIII by Nicholas Banester against said Roger of said Manor, which said receevery was to the uses declared in an Indenture, made between the said Roger Ryssheton of the one part, and Geffery Rishton of Martholme gent. of the other part, which said Indenture follows in these words:-

"It is agreed that Roger will suffer a recovery at the next Sessions to be holden at Lancaster of all the Manors Messuages, lands etc, etc, & all other hereditaments of the said Roger in the Co. of Lancr. & elsewhere within the Realm of England, to the use of the said Roger for his life & after his decease to the use of Rauffe, son & heir apparent of the said Roger for his life only & after the decease of said Rauffe to the issue male of the said Rauffe & for default of issue male. Remainder to the issue of the said Roger for ever. Dower to wife or wives of said Roger for life only."

Reciting a fine levied on Monday in the 6th week of Lent 2 Eliz. between William Ryssheton & George Fysher Plaintiff & the said Raphe Deforciant of the said Manor, by which Raphe quit claimed the Manor of Powtalghe to the said William & George & to the heirs of the said William for which William & George granted the said Manor etc, to the said Raphe & to his heirs.

The jurors also say, that the said Roger Riston was seized of one manor or capital messuage called Powtalghe in the township of Churches & of lands in Churche & Rissheton for the life of the said Roger with remainder to Raphe and his heirs. The said Raphe was also seized of 2 messuages called Whyte Ashe & of land in Oswoldtwyssll & the said Raphe by his Charter 2nd Aug. 3 Eliz. granted all the said Messuages, lands etc, in Churches, Oswoldtwyssill and Ryssheton to John Atherton of Atherton Knt & John Townley to the uses mentioned in a Schedule annexed to the said Charter viz;

To the use of the said Raphe & of his issue in default to the use of William Rishton, brother of said Raphe & of his heirs, the tenor of which said Charter & Schedule follow in these words:-

"I, Raphe Rissheton of Dunkenhalge gent. have granted to John Atherton and John Townley all my Manor or messuage of Dunkenhalge & all other my messuages, lands etc, in Clayton on the Moors, Ryssheton, Church, Oswoldtwyssll, Lancaster & Scotforth to have & to hold to the said John Atherton & John Towneley, their heirs & assigns, to fulfil a certain Schedule to this my Charter annexed & I the said Ralphe Ryssheton have granted to the said John Atherton & John Towneley all reversion of the Manor of Powtalghe to have & to hold to said John Atherton & John Towneley their heirs & assigns, to the use of a certain Schedule to this Charter annexed."

Now the uses of this Deed of Feoffement wherewith this Schedule is annexed is, that the said Feoffees & their heirs shall be seized of the said Manors etc, to the use hereafter declared to wit the said feoffees shall stand seized of the said Manor of Dunkenhalgh with all lands etc, to the use of Raphe Rysshton the feoffor for life & of the Manor of Portalghe to the use of Roger Rysheton, father of said Raphs, for his life & after the decease of Raphe then to such issue male as shall be begotten by the said Raphe & for default to the use of .............. [perished] Ryssheton, brother of the said Raphe the feoffor & his heirs provided that if ................ [perished] Rysshton, otherwise Stanley do survive the said Raphe, then the said feoffees to stand seized of the Capital House called Dunkenhalgh with those closes (named) for the life of the said Anne, also if the said lands in the feoffment specified come to the said William Ryssheton, then he shall yearly pay to Nycolas Rysshton, Roger R, William R, Henry R & Geffery R, sons of the said Raphe 40/- during their lives, and at such time as any of the .............. [perished] fortum to die, the said William R. shall pay to John Ryssheton, son of Henry Ryssheton yearly during his life £10.

And the Jurors also say that Ralph [? perished] Rysshton before his father's death, made a certain Indenture the tenor of which follows in these words:-

Indenture made 10 Augt 3 Eliz. by which Raphe Rysshton of Dukenhalgh, bargains & sells to Giles Parker & Bryan Parker all the Manor called Powtalghe & messuages etc, in Church, Ryshton & Blackburne now in the tenures of etc, (names given) Also the said Rapbe bargains & sells to the said Giles & Bryan all that the Manor of Dunkenhalghe with the lands etc.

To hold to the use of the said Raphe the feoffor for his life. Remainder to ................ [perished] Ryssheton his son & heir apparent & his issue for default to the use of Wm. Ryshton, one of the younger sons of the last named & to his issue male for default to use of the said Raphe the feoffor & his heirs, with a provision that the feoffor may give every of his younger sons an annuity of 5 marks for their lives. Provided also that if the said Raphe pay to the said G. Parker & B. Parker 12d the said G P & B P shall be seized of all the premises to the use of the said Raphe the feoffor for his life. Remainder to the said William R & his issue. Remainder to the said Raphe the feoffor & his right heirs for ever.

And the Jurors say that the said Raphe Rysshton died on the 10th January last past [1571/2] and that William Ryssheton brother & next heir of the said Raphe is aged 49 years.
