Description

Attested copy will of Thomas Duppa of Eardington esq.

He appoints his wife Georgiane Elizabeth Duppa, Thomas Duppa Duppa of Cheney Longueville esq and Rowland Price of Stourbridge gentleman, trustees of this will and his wife the sole guardian of his children, or after her death Duppa and Price.

He bequeaths all his real and personal property to the trustees on trust to receive the income, maintain buildings and carry on the trade he now carries on, and pay the residue to his wife for life or widowhood for the maintenance of herself and the children, after on trust for the benefit of the children in equal portions until the youngest is 21, for their education and maintenance, and then to assign to the children in equal, shares as tenants in common, a son's share to be a vested interest when be becomes 21, and a daughter's share when she becomes 21 or marries. The trustees may sell. Fresh trustees may be appointed. They shall not be liable for losses through a banker or agent, or for losses incurred in carrying on trade.

It shall be lawful but not obligatory for them to carry on the trades the testator now carries on or either of them, and to employ agents, or to grant leases of the real estate for terms not exceeding 14 years, any lease to expire within one year of the youngest child attaining the age of 21. They may sell or let any part of his coal, brick or other works and the engines and machinery now used at the works, and to purchase or rent seams of coal, clay, ironstone or other minerals and the land under which such seams may be, and any land necessary for railways or roads, and to sell seams or minerals under his estate at Eardington to which the testator is entitled as lord of the manor of Eardington. He charges his real estate with payment of debts now due
