Recital of release of 19 November 1742 (1514/575) being the settlement on the marriage of Marmaduke Langdale with Constantia Smythe, which recited that Constantia was entitled to the whole or a considerable part of the estates of Clare Smythe, spinster daughters of Sir Richard Smythe late of Esh, Durham, decd, if Clare died unmarried and intestate. Const. and Maramduke agreed with Sir Edward Smythe and Sir Edward Gascoigne that when Clare died intestate and unmarried the Langdales would make assignments for vesting in Sir K.S. & Sir K.G. Constantia's share in the personal estate of Clare, on trust by sale & c to convert the same into money, Sir E.S. retaining to himself £2000 in recompense of the like sum advanced to Constantia; on trust to raise £500 out of the remainder to the use of such persons as Constantia directs - till then Sir E.S. & Sir E.G. to hold it to the use of Constantia.
Sir Edward Gascoigne has died, and on 24 March last Clare Smythe died unmarried and intestate, possessed of a very considerable personal estate, and administration of her goods and credits was granted to Sir Edward Smythe who with his brother Walter Smythe and the said Constantia his sister are the only next of kin of Clare.
Now Constantia Langdale directs and appoints Sir Edward Smythe out of the produce of the remainder of the share to which she or Marmaduke is entitled after Sir E.S. has kept the £2000, to pay the £500 to Anthony Wright of St. Paul, Covent Garden, banker, to her, Const:'s use.
