Description

Whereas by Indres of lease & release of 22 & 23 November 1770, the release between Humphrey Sandford Esq (late father of Folliot Sandford) and Elizabeth his then wife and late widow, and their eldest son Humphrey Sandford jnr since decd (1) Francis Walker and Thomas Harries Esquires (2) John Harries, gent. (3) Thomas Ottley, Esq & Roger Kynaston, Esq (4) and by virtue of a common recovery in pursuance of the indres, the Manor of Edgeton with all rights, members & appurtenances belonging and all the several messuages lands, tenements and hereditaments therein mentioned in Edgeton, Brunslow, Horderley, Wolston, Up Rossall, Priest Weston alias Weston Parva and Middleton were limited after the death of H.S. snr and of H.S. jnr without issue male (subject to an annuity of £250 thereby charge on the hereditaments and premises for Elizabeth Sandford during her life and the remedies for recovery thereof, and a term of 400 years thereby created for securing the annuity & other trusts therein mentioned, to Folliot Sandford for his life without impeachment of waste with remainders to his sons successively in tail male with remainder to Edward Sandford another son of H.S. snr. with divers remainders over, in which release is a proviso whereby it was declared between the parties that it should be lawful for H.S. jnr, F.S. & E.S. or any future son of H.S. snr by Elizabeth as they should be seised of the immediate freehold of the manor etc. to them limited for life to grant, limit or appoint any of the term of 400 years or any annuity to issue out of the same, to the use of any wife or wives they should marry for the life of such wife for her or their jointure and in lieu of her or their dower, so that the manor etc. or annuity did not exceed £100 p.a.; and to charge the Manor etc. with any sum as a provision or portion for any younger child(ren) of H.S. jnr, F.S. & E.S. not exceeding in the whole £2,000 for the younger child(ren) of them; and with maintenance for such younger child(ren) not exceeding the interest of the fortune of such younger child(ren) to be computed after the rate of 4% p.a.; and whereas F.S. is seised of the immediate freehold of the Manor etc. and is desirous of executing the recited powers by making a provision for Isabella Sandford, his wife, in case she survives him, and for the younger children he now has and may have; now F.S. in execution of the power of jointuring reserved to him by the indre of release has granted, limited and appointed to Isabella his wife an annuity of £100 for her life, jointure to begin immediately after the death of F.S. & to issue out of the Manor & other premises by 4 equal quarterly portions on every 25 March, 24 June, 29 Sept. & 25 Dec. to be in full satisfaction of dower which Isabella can or may claim out of the manor etc. which F.S. now is or at any time hereafter during the coverture between him & his wife shall be seised of any estate of inheritance and the 1st payment of the annuity to be on the day of payment next after F.S.'s death and F.S. in exercise of the powers reserved to him for making a provision for his younger children charges & subjects the Manor & premises with the payment of £2,000 for the portions of all the younger children to be equally divided between them and paid to such of them as shall be a son or sons on his attaining 21 and to daughters on attaining 21 or being married which shall 1st happen in case F.S. is then dead otherwise on the death of F.S.; & in case any of such younger children become an eldest or only son or dies before his portion is due without leaving any issue living at his death or born in due time afterwards then the share of him or her shall go to the survivors in equal shares when their original portions become payable; and F.S. directs that all the portions to be paid to the survivors shall survive with the original portions until the latter are payable; and if any of the younger children being a son under 21 or a daughter under such age & unmarried at the death of F.S., F.S. charges & subjects the Manor etc. with such sum for the maintenance of such younger child(ren) until they attain 21 or marry, in the case of a daughter, as the interest of their shares of the £2,000 shall come to after the rate of 4% to be computed from the death of F.S.; provided it shall be lawful for F.S. at any time by any deed to revoke or alter the annuity of £100 and to grant the Manor etc. or any annuity out of them to the use of Isabella for her jointure in lieu of dower, so that the Manor or annuity etc. does not exceed the yearly sum of £100; and provided that it shall be lawful for F.S. at any time by any deed to revoke or alter the charge made for the portions and maintenance of the younger children not exceeding £2,000 & the maintenance not exceeding the interest of the portions at 4% p.a.
