Humphrey Sandford of the Isle, in health of body sound of mind and memory, devises:- Body to be decently interred at the discretion of the executrix at Bicton chapel in the funeral vault wordly goods, debts and funeral expenses to be satisfied. Whereas by indentures of lease and release, November 23rd 24th 1770, the release between Humphrey Sandford, Elizabeth his now wife, and Humphrey Sandford, eldest son, since deceased, 1st part, Francis Walker, and Thomas Harris, 2nd part, John Harries gent. 3rd part Thomas Ottley and Roger Kynaston esq. 4th part.
By virtue of a common recovery of several manors messuages, lands etc. limited to John Harries with various trusts, and intents:- concerning the manor of Bayston with messuages, lands etc. belonging, then in the occupation of William Wood and John Kendrick, to such uses or upon such trusts as Humphrey Sandford shall appoint, and in indenture of settlement contained proviso that if there should be male issue of Humphrey Sandford and Elizabeth living at the time of testator's death he should be immediately entitled to the freehold of Bayston according to the limitations made, and to premises mentioned in Edgton, Horderley, Brimslow, Woolston and Up Rossall, Priest Weston and Middleton, and that if there should be daughters and younger sons living at the time of testator's death, then lawful for him to charge premises by creating a term of trust, as he or Elizabeth his wife should think fit, for raising a sum not exceeding £2000 to be divided among the younger children as Humphrey Sandford or Elizabeth should devise. By power of above indenture, devised in presence of three witnesses to Edward Harries of Hanwood, the manor of Bayston and all the messuages, lands etc. belonging for term of 500 years, immediately following testator's death, that from the rents and issues or by sale or mortgage of premises he shall raise £2400 to be divided among the 5 daughters of Humphrey Sandford, Elizabeth, Frances, Barbara, Susannah and Charlotte in equal shares with interest at 5% following the decease of Humphrey Sandford until payment shall be made. If one daughter shall die unmarried in the lifetime of Humphrey Sandford, testator, then share not to, be divided among survivors, but to revert to the inheritance of Bayston. After the expiration or sooner determination of the 500 years term, the manor of Byston and appurtenances, are devised to Edward Sandford and heirs, in default of which to the use of grandson Humphrey Sandford, eldest son of son Folliot Sandford, and heirs, in default to the 1-6 or other sons of Folliot Sandford. The estate at Bayston to descend to Humphrey the grandson or his younger brothers in order of seniority, but appointed that neither Humphrey or any younger grandson shall be entitled to receive the rents or profits of the Bayston estate until Humphrey or other grandson shall be in actual possession of the estates at Up Rossall and Edgton, and that for the present the rents and profits are subject to the £2400 payment for the daughters, and shall be received by Edward Harries, and applied to and for the use of the grandson, and paid and accounted to him for the necessary outgoings, being to be deducted, with all expenses that have been incurred for the management of the Bayston estate. Concerning the manor of Edgton and lands, etc. in Edgton, Brimslow, Woolston and Up Rossall limited in the above indenture to Edward Harries for 1000 years, the term to begin immediately the decease of Humphrey Sandford testator. Immediately after decease Edward Harries shall by mortgage of premises levy £2000 and divide among the 5 daughters in equal shares, but if one should die without issue, then the share to be divided among the survivors with full interest, to be accounted from the day of Humphrey Sandford's decease. Provided that if one of the daughters shall have married in Humphrey Sandford's lifetime and received a portion, the shares being portioned in £2000 and £2400; so much as she has received already shall not be raised but shall revert to the inheritance of the premises. The trustee shall out of the two sums of £2000 and £2400 keep such sums as he shall sustain or be put on account by reason of the trusts executed, but the costs and charges are to be paid to the trustee by the heirs in possession of the estates. To Elizabeth Sandford, all personal estate, household goods, stock of cattle, horses, linen, plate, books,ready money, debts owing to him or to which he is entitled to in law or in equity and all goods and chattells whatsoever; 5 guineas to be distributed among the poorest inhabitants in Bicton Chapelry. Elizabeth Sandford 'dear wife' appointed sole executrix to will. Witnessed G. Crump, William Oswell, Edward Hutton.
Codicil : Stated in will that funeral expenses and just debts to be paid out of personal estate, Real estate now to be appropriated for the payment of debts, funeral expenses and legacies, and several parcels of land, called The Rice, the Long Edley, part of the Sour Butts, of c. 3 acres, the Brook acre, of c. 6 acres, Weston Leasow, Green Leasow, the Red Meadow, the house by the lane, another house and gardens in Little Weston town, and a piece of land called The house close situated in Priest Weston, parish of Chirbury, now or late of John Butler at yearly rent of 30s; the messuage in Priest Weston, now of Humphrey Marston, and now under lease for 2 lives at rent of £4-5s. p;a. to Edward Harries of Hanwood for 500 years beginning immediately after decease of Humphrey Sandford, upon trust that Edward Harries shall levy, by sale or mortgage of real estate, to pay debts, legacies and funeral expenses. Personal estate to be charged with payment of above, if sum raised from real estate should be insufficient, and as in will the residue of personal estate bequeathed to Elizabeth Sandford.
