Agreement between the Rev. Humphrey Sandford of Shrewsbury clerk, 1st part, Frances Holland widow and relict of George Holland (Rev., clerk) 2nd part, Frances Holland daughter and only child of George Holland 3rd part, Jonathan Scott and Robert Pemberton esq. both of Shrewsbury 4th part and Francis Southern of Lydbury North and the Rev William Henry Parry of St John's College Cambridge clerk, now resident in the family of His Grace the Duke of Portland 5th part. Whereas a marriage is to be celebrated between The Rev. Humphrey Sandford and Frances Holland. Whereas by indentures of lease and release April 28th & 29th 1790 (465/616, 465/617; settlement previous to the marriage of Frances Sandford and George Holland) Agreed that the term of 500 yrs limitted to John Scott and Samuel Holland is upon trust in case there should be one or more children of George Holland. Whereas by indentures of agreement May 12th 1790 between George Holland, one part, and Humphrey Sandford since dec. after recitation of earlier indenture of lease and release, that George Holland should within 6 months after the marriage should grant & secure to Humphrey Sandford several pieces of land in the parish of Tenbury; to hold for 500 yrs from the decease of George Holland on trust in case there should be one or more daughters or younger sons of Frances Sandford and George Holland to raise £1000 for their benefit. (issue Frances Holland only child) Whereas by indenture August 17th 1808 (see 465/639) Whereas George Holland and Frances his wife did not make appointment of the sum of £4800 and whereas Edward Sandford late of Shrewsbury, after of Walcot Esq (county of Somerset) by will dated October 13th 1801 bequeathed all moneys, securities and stocks to the Rev. John Gibbons and the Rev. John Wilde clerks upon various trusts:- £500 in trust to pay to permit his sister to take the interest, dividends for her life, exclusive of her husband and after the decease of his sister Frances Holland, in trust to transfer the sum of £500 and the security on which the same is invested to his niece Frances, at age of 21 or when she should marry, and now to accumulate; whereas George Holland of Shrewsbury executed in last will Aug. 27th 1804 appointed that all his debts and funeral expenses should be paid out of his personal estate and if inefficient his real estate should be charged with payment; whereas George Holland taking notice of the indenture of settlement April 28th 29th 1790 that he was entitled to the reversion of premises in Kyrewood (465/618) Premises comprized in this settlement to Frances Holland daughter, Frances Holland wife appointing as executrix. Whereas the premises at Tenbury referred to in 465/ , are the same one that George Holland conveyed to Edward Wheeler; at time of his death George Holland was seised of the messuage in St Mary's parish Shrewsbury, & a small tenement in Tenbury, now of Edward Clent, and entitled to £1074-15s-10d capital stock in the 63% consolidated Bank annuities; Whereas in the agreement for the marriage it was agreed between Frances Holland the elder and younger and Humphrey Sandford that if the marriage should take place the moneys, estate etc. to which Frances Holland should be entitled should be reconveyed to various uses and trusts:- Whereas by indentures of lease and release on Nov. 14th & 15th 1804, between Folliot Sanford of the Isle 1st part, Humphrey Sandford son of Folliot 2nd part, Richard Griffiths 3rd part, (see 465/633) concerning the manor of Up Rossall and Edgton with appurtenances, and that capital messuage or manor house in Up Rossall with orchards, gardens, pleasure grounds belonging, late in the occupation of Folliot Sandford, now of Colonel Gatacre, 75 acres, 1rd, 33 perches, and The Isle Farm late of John Weston, now of Elizabeth his widow, since of Edward Gittins, now of Simon Hiles, 210 acres, 3rds, 15perches. Isle Park Farm, now in possession of Stephen Matthews, the Isle Gate farm now of Robert Mansell etc.

Present indenture witnesses that in consideration of the intended marriage and of the fortune of Frances Holland, and to make provision for her if she should survive Humphrey and for provision for children, that Humphrey Sandford, when Frances shall reach 21yrs, if the marriage shall then have taken place, shall grant to Jonathan Scott and Robert Pemberton, all the messuage held by Charles Sandford and Christopher Wilkes, now by Folliot Sandford, by lease for 99 years at £150, to hold by Robert Pemberton and Jonathan Scott for 40yrs from the decease of Humphrey Sandford, upon trust that they shall pay to Frances the rents and issues of the premises for her life. if Folliot Sandford lives so long and at his decease the term of 40yrs to cease Also by same indenture that Humphrey Sandford will demise to Robert Pemberton and Jonathan Scott (subject to the grant of above premises) all the manors, messuages, lands, tenants' chief rents, rents, payable by :-The Earl of Craven 4d, Mr Beddowes of Brunslow 12s-8d, Mr Edward Lucas 1s-3d, Mr Richard Bird 2s, Mrs. Elizabeth Knight for her estate at Wolston within the manor of Edgton 10s.-5d, Thomas James of Wolston 7d, Mr Rogers of Wolston 4d, Edward Plowden esq. for his estate at Horderley, 1s, hereditaments and premises, and that piece of woodland called Flat Wood, 20 acres, and parcel called The Lower Wood 19 acres, 2 roods, 20 perches, in Edgton in the occupation of Folliot Sandford, and the undividmoiety of land called Bunche, situated between Brunslow and Kempton, containing 2 acres, 12p with all lands, farms etc contained in the indenture of Nov. 14th & 15th 1804. To hold by Jonathan Scott and Robert Pemberton for 99 yrs with the intent that Frances Holland, after death of Humphrey Sandford may receive out of the manors and premises a yearly rent charge of £150 during her life for her jointure, to be paid at Lady Day and Michaelmas; clauses of distress and rentry to be inserted in cases of nonpayment. Also that Humphrey Sandford will limit and appoint (without prejudice to the annuity of £500 to be secured to Frances Holland) all the manors lordships, tenements, chief and other rents and premises to Francis Southern and William Henry Parry for 2000yrs; upon trust that in case there should be an elder son, younger sons or daughters, William Henry Parry and Francis Southern shall out of the rents and profits of the premises comprized in the term, by sale or mortgage of all or a competent part raise £4000 for the portions for the younger children of Humphrey Sandford, to be paid to them in such portions as Humphrey Sandford shall appoint in his will.; in default of such direction to be divided in equal shares, paid at 21 yrs or at time of marriage, with interest at 4%. Further in consideration of the marriage and to make better provision for Frances Holland if she should survive Humphrey Sandford, agreed that the sums of £7260, 16s, and £1074-15s-10d capital stock in the 3% consolidated Bank annuities and the legacy of £500 from will of Edward Sandford to which Frances Holland will become entitled at her marriage, subject to the life interest of Frances Holland the elder, will be transferred to Jonathan Scott and Robert Pemberton, within a month after the marriage: upon trust that they shall pay during the life of Frances Holland the elder the interest and dividends of the sums, & after her decease upon trust that Jonathan Scott and Robert Pemberton shall pay the dividends and interest to Humphrey Sandford. After his decease on trust that the trustees shall empower Frances Holland to receive the dividends and interest, for her natural life, if Folliot Sandford shall live so long: after his decease that the trustees shall sell out the capital sums of £7260-16s, & £1074-15s-10d, 3% consolidated Bank annuities, and receive the legacy of £500 and apply the same with interest in discharging the incumbrances charged upon the manors and estates of Humphrey Sandford. It shall be lawful for Jonathan Scott and Robert Pemberton, with the approval of Frances Holland, Humphrey Sandford, and Frances Holland the younger to dispose of the various sums of money and to invest the same after deducting their costs and charges in any real government security upon the trust described. They shall not be accountable for any loss that may occur without their wilful default. Further that Humphrey Sandford and Frances Holland with the consent of Frances Holland the elder, will when Frances shall become 21 make assurances in law to ensure the better conveying of premises in Shrewsbury, tenbury etc. to Jonathan Scott and Robert Pemberton trust that they shall empower Humphrey Sandford to receive the rents and profits after the death of Frances Holland the elder, for the term of the life of Folliot Sandford his father, on trust to empower Frances Holland the younger to receive the rents and profits during her natural life; further trust that Jonathan Scott and Robert Pemberton shall sell or convey the premises in whole or part for the best price offered; further that they shall apply the moneys in discharge of the incumbrances charged on the manors and estates of Humphrey Sandford. Power given to Humphrey Sandford that with the consent of Francis Southern, William Henry Parry, Robert Pemberton and Jonathan Scott he can sell and dispose of the premises comprised above, in whole or part, and the proceeds of the sale to be expended on the purchase of other estates in fee simple in any part of England or Wales.

Clauses to be inserted in the agreement for the security and indemnity of the trustees.
